I´m going to make a texture pack of super mario advance 4(looks like SMB3, but not so pixelated), but Nintendo has copyrights of the game and of its graphics. I´m already having a nice looking version(not ready yet), but what should I do with the copyrights?

You aren't going to ask Nintendo personally, are you? Thus, you can't (remember: it's not because everyone does something it is legal).

So may I not upload it?

I think you can upload it as long as you have permission from the author of the images, and you have to disclose if anyone owns the copyright to the characters depicted.
