We most probably could, but we may not. I'm sure you read that guy's post up to where he states :

If you want to use my textures in your pack:
You can use, edit and share my textures as long as I'm credited
You are not allowed to make money with my work
And you are not allowed to use my textures in a customizer or in any other games else than Minecraft.

But I agree, it's pretty gorgeous. Maybe you should ask him permission (and then, it wouldn't be a problem anymore).

Ask creators to release their packs under a compliant license (I guess any CC without the NC clause should be safe), and I'll be more than glad to help convert their packs.

I'll give it a try, yeah. After all, it's little more than cutting terrain.png in separate files. Nothing anyone couldn't handle with his loyal MS Paint.

But to be precise, the CC license shouldn't use ND (No Derivative works), in addition to not using NC (No Commercial derivatives). There are some "CC-BY" packs around, if you don't succeed in changing the guy's mind.
